Type: Workers' Compensation
Parties: Snodgrass v. Baldwin Trucking
Injuries: Death
Brief Description: A trucking company initially denied workers' compensation benefits to the son of a truck driver who was killed in an accident, claiming that methamphetamine was found in his blood and urine. Keith Douglas Snodgrass was killed January 1997 while driving a tractor-trailer near Columbus, Ohio for Baldwin Trucking Company based in Springfield. The chief toxicologist tested the body and found an allegedly toxic level of methamphetamine in the blood and urine. The employer denied benefits to Snodgrass' 7-year old son on the basis that the injury was idiopathic and the accident was not in the "course and scope of employment." The claimant produced evidence that methamphetamine can be found in Vick's Inhaler and other over the counter medicine. The settlement was reached after one-half day of testimony by Dr. Norman Belz, an occupational physician who deals with toxicology issues in his practice.
Settlement Awarded: $130,000.00
