Brief Description: The plaintiff was a 36 year old man who
sued a truck stop and security guard after being struck by a car
while walking on the premises. An off-duty employee of the truck
stop was found to have a blood alcohol content level of .21. The
plaintiff stated that the employee had been drunk on the premises
for an hour before the accident and that police and security were
not notified. The plaintiff claimed that the security guard should
have observed that the man was drunk and should have intervened.

Parties: Puckett v. Southern Construction Company
Injuries: Amputation of left arm below the elbow, severe damage
to right arm.
Brief Description: In January 1998, Scott Puckett, came into
contact with a power line while working for Southern Construction
Company. He suffered the loss of his left arm from the elbow and severe
damage to his right arm. Puckett filed for and received social security
benefits. He also sought workers compensation benefits, including
future medical expenses. The parties settled the workers' compensation
claim three days before the hearing.

Parties: Mickle v. Miracle Recreation Equipment Co, et al.
Injuries: Five traumatic and repetitive-motion injuries to
shoulders
Brief Description: The claimant was a metal fabrication employee
who made a workers' compensation claim based on five shoulder injuries.
The claimant used a variety of machines, and his duties involved
lifting of metal parts of various sizes and weights hundreds of
times per day up to or above shoulder height, with elbows outstretched.
Four of the claimant's injuries required surgery. The parties stipulated
that two of the injuries were compensable. The ALJ found that injuries
were caused by the claimant's repetitive lifting of metal parts
on the job, which caused stress and eventual tears of the rotator
cuffs, and awarded the worker $76,747.

Parties: Snodgrass v. Baldwin Trucking
Injuries: Death
Brief Description: A trucking company initially denied workers'
compensation benefits to the son of a truck driver who was killed
in an accident, claiming that methamphetamine was found in his blood
and urine. Keith Douglas Snodgrass was killed January 1997 while
driving a tractor-trailer near Columbus, Ohio for Baldwin Trucking
Company based in Springfield. The chief toxicologist tested the
body and found an allegedly toxic level of methamphetamine in the
blood and urine. The employer denied benefits to Snodgrass' 7-year
old son on the basis that the injury was idiopathic and the accident
was not in the "course and scope of employment." The claimant
produced evidence that methamphetamine can be found in Vick's Inhaler
and other over the counter medicine. The settlement was reached
after one-half day of testimony by Dr. Norman Belz, an occupational
physician who deals with toxicology issues in his practice.
